The Makkah mosque incident has sparked debate following viral claims that two Bangladeshi migrant workers, Nazrul Islam Abdul Basir and Siti Akhtar, were newlyweds executed for kissing. The report disputes this narrative, stating that the individuals were convicted by Saudi authorities of committing an explicit sexual act inside a mosque and sentenced under Ta’zir, a category of discretionary punishment in Islamic jurisprudence.
The incident has prompted calls for Islamic scholars and institutions, including Al-Azhar and the League of Muftis, to examine the application of Shariah in such cases. While the sanctity of mosques is central to Islamic teachings, the commentary stresses the importance of procedural justice, transparent legal proceedings and consular access, alongside consideration of repentance, remorse and privacy.
The debate also raises questions about the proportionality of punishment. Although the use of capital punishment as Ta’zir has been historically debated among Islamic jurists, the commentary urges scholars to consider whether alternatives, such as lengthy imprisonment or deportation, could better balance justice with mercy in similar cases.
